Who we are, and what this covers
Quaryan is operated by Twin Pines GmbH, Denter Ers 14, 7403 Rhäzüns, Switzerland (“Quaryan”, “we”, “us”). These terms cover the app at app.quaryan.com, the website at quaryan.com and any account you hold with us.
By creating an account or using the service you agree to them. If you sign up for a company, you confirm that you may accept these terms on its behalf, and “you” means that company.
If we have agreed something else with you in writing, what we agreed there wins over what is written here.
What Quaryan does
You give Quaryan the address of a website or an app. Quaryan reads it and produces marketing work from it: a summary of the product, a marketing strategy, SEO and GEO audits, ad plans, and the numbers behind the channels you connect.
What your plan includes is what the pricing page said when you subscribed, and what your account page shows now. Parts of the product are still being built, and the product says so where that is the case.
What the advice is, and what it is not
Quaryan’s output is generated by AI models from your website, from what you tell us and from public information. It is a suggestion. It is not legal, tax, financial or professional advice, and it is not a promise about rankings, traffic, revenue or any other result.
Check anything that matters before you act on it — claims about your product, prices, competitor names, legal wording. What you publish is published by you, and you are responsible for it.
The same input can produce different output on a different day, and another customer can receive something similar to what you receive.
Your account
You need an account to use Quaryan, and the details on it have to be accurate and kept current.
Keep your sign-in to yourself. What is done with your account is treated as done by you, so write to hello@quaryan.com as soon as you think someone else is in it.
You have to be 18 or older, and you may not use Quaryan if sanctions or export rules where we or you are mean we may not serve you.
Plans, prices and payment
You buy from Twin Pines GmbH. We are the seller, the contract for your subscription is between you and us, and the invoice comes from us. Payment is collected for us by Stripe: its checkout takes your card details, which never reach Quaryan, and it shows the tax for your country before you confirm.
The Free plan costs nothing and has no end date. Paid plans are billed monthly in advance at the price shown when you subscribe, plus VAT where it applies.
A paid plan renews each month until you cancel it. Cancelling stops the next renewal and leaves the month you have paid for running to its end. An upgrade starts immediately and is charged for the rest of that month; a downgrade starts at the end of it.
If a payment fails we may pause the paid features until it goes through. We may change prices for a future billing period, and will tell you at least 30 days before, so you can cancel first.
If you change your mind
If you are a consumer in the EU or EEA you may withdraw from a paid subscription within 14 days of subscribing, without giving a reason. A message to hello@quaryan.com is enough.
A subscription works the moment it starts, so by subscribing you ask us to begin during those 14 days. If you then withdraw, we may keep a proportionate amount for the part you used, and the right ends once we have fully performed.
Your website and your content
What you bring stays yours: the site you point Quaryan at, the text you write, the accounts you connect and the data in them.
You give us the right to store and process it, and to pass it to the providers named under “Connected services”, to the extent needed to run the product for you. That right lasts as long as the data is in your account and ends when it is deleted.
You confirm that you may share it with us — that the site is yours to market and the content is not someone else’s to license.
What Quaryan produces for you
The plans, audits, briefs and ad copy generated for your account are yours to use, change, publish and deliver on to your own clients, for as long as you keep to these terms.
The platform stays ours: the software, the prompts behind it, the design, the name and everything we make available to every customer. Nothing here transfers it to you, and a plan is a right to use the service rather than a licence to it.
Using it fairly
Quaryan is for marketing your own product, or your client’s. It is not for:
- anything unlawful where you are, where we are, or where the marketing runs;
- content that is deceptive, defamatory or hateful, or that impersonates a person or a business;
- unsolicited bulk messaging, or marketing to people who have not agreed to receive it;
- promoting fraud, malware, or the sexual exploitation of children;
- scraping the service, reverse engineering it, reselling raw model access, or working around the limits of a plan;
- anything that puts unreasonable load on the service or degrades it for other customers.
If it happens we may suspend or close the account. Where the breach can be fixed and nobody is being harmed meanwhile, we will ask you to fix it first.
Connected services
Quaryan runs on services other companies operate: Google Firebase for sign-in, Stripe for payment, Google Ads once you connect an account, and the AI providers that generate the output. Their terms apply to their part of the work.
Connecting an account allows us to read and use it as the feature needs. You can disconnect it whenever you like; what has already been produced stays in your account.
If one of those services changes, breaks or withdraws something, a Quaryan feature that depends on it can change with it.
Availability, and a product that keeps changing
We work to keep Quaryan up and quick, but we do not promise a level of availability, and we may take it down for maintenance.
Generating a plan or an audit is real work and can be queued or paused when demand runs ahead of capacity. When that happens the product says so rather than inventing a result to fill the space.
Features are added, changed and removed. If we remove one that a paid plan of yours relies on, you may cancel and we will refund the unused part of the month.
Data protection
We process your account data — your name, your address, your sign-in and your billing details — to provide the service and to meet our legal obligations. We process what you bring into a campaign on your instructions, and we do not sell it.
It reaches the providers named under “Connected services” only to the extent the product needs, and only for as long as your account holds it.
You are responsible for the personal data you put into Quaryan and for having a basis to share it with us. Write to hello@quaryan.com for a copy of what we hold about you, or to have it deleted. Ending it
You can cancel a paid plan at any time and go on using the Free plan, or ask us at hello@quaryan.com to close the account altogether.
We may end the agreement with 30 days’ notice, or immediately if you breach these terms seriously enough that waiting is not reasonable.
When an account is closed we delete its campaigns, plans and audits within 30 days, apart from what we have to keep for accounting or legal reasons. Export anything you want to keep before you close it.
Warranty and liability
Quaryan is provided as it is. We do not warrant that its output is accurate, complete or fit for a particular purpose, or that the service will be uninterrupted or free of errors.
We are liable without limit for intent and gross negligence, for injury to life, body or health, and wherever the law does not permit a limit. For ordinary negligence we are liable only for breaching an obligation the contract depends on, and only for the damage typical of a contract like this one.
Otherwise our total liability over any twelve months is limited to what you paid us in those twelve months. We are not liable for lost profit or revenue, or for what follows from a decision you took on the strength of Quaryan’s output.
Nothing here limits the rights a consumer has that cannot be limited by agreement.
Changes to these terms
We may change these terms when the product or the law changes. If a change affects you we will email you at least 30 days before it takes effect.
If you do not want the new version, cancel before that date; using the service afterwards means you accept it. A change that is purely in your favour, or that the law requires immediately, may take effect sooner.
The rest
These terms are governed by Swiss law, without its conflict-of-law rules. If you are a consumer you keep the protection of the mandatory law of the country you live in.
Disputes are heard by the courts at the registered office of Twin Pines GmbH in Rhäzüns, Switzerland, unless the law requires them to be heard elsewhere. The European Commission’s online dispute resolution platform is at ec.europa.eu/consumers/odr.
If a clause turns out to be invalid the rest stays in force. You may not transfer this agreement without our consent; we may transfer it to whoever takes over the business, and will tell you if that happens.
